Social media platform TikTok appealed to the U.S. Supreme Court on December 16, seeking to block the implementation of the “Sell or Ban” law. The law requires TikTok to separate from its Chinese parent company ByteDance by January 19, otherwise it will face a complete ban in the United States. The U.S. Supreme Court decided to hear the case and plans to hold oral arguments on January 10. AFP said that TikTok has achieved initial results in the U.S. legal battle. AFP reported that TikTok ushered in a “preliminary victory” in the U.S. legal battle on Wednesday, and the U.S. Supreme Court agreed to review the “constitutionality” of a law requiring its Chinese parent company to sell TikTok or face a ban. Short video sharing application software TikTok formally appealed to the U.S. Supreme Court, requesting a stay of the implementation of the “Sell or Ban” law, and asked the court to make a ruling by January 6 next year. The U.S. Congress passed the bill with a bipartisan majority in April this year. The bill aims to prevent the Chinese government from manipulating its users and conducting “espionage” through TikTok. TikTok has 170 million users in the United States. The law was quickly signed into law by President Biden and requires TikTok’s parent company ByteDance to comply with the regulation by January 19. TikTok has repeatedly denied providing user data to the Chinese government and insisted that it would refuse such a request even if it were made. On December 6, TikTok’s appeal against the law in the Federal Court of Appeals in Washington was rejected, and its request for a stay of execution on December 13 was also rejected. However, the US Supreme Court agreed to hear the case on Wednesday. Although it did not suspend the law from taking effect, the court will hold arguments in the case on January 10, 2025, focusing on whether the law violates the right to free speech guaranteed by the First Amendment of the US Constitution.
